Swimming Pools & Hot Tubs
Building permit for swimming pools and hot tubs: All structures that meet the definition of swimming pool must receive a building permit before the start of construction or placement.
The definition of swimming pool: Any structure, basin, chamber or tank which is intended for swimming, diving, recreational bathing or wading and which contains, is designed to contain, or is capable of containing water more than 24 inches deep at any point. This includes in-ground, above-ground and on-ground (inflatable) pools, indoor-pools, hot tubs, spas and fixed- in-place wading pools. Property set back requirements: All swimming pools must be located at least 15 feet from any side or rear lot line.
Barrier requirements: All swimming pools shall be surrounded by a barrier which shall comply, but not limited to the following. The top of the barrier shall be at least 48 inches high and all gates must be self closing and self latching. Doors from the home with access to the pool shall be equipped with an alarm which produces an audible warning when the door is opened.
Alarms: All swimming pools shall be equipped with an approved pool alarm. Pool alarms shall activate upon detecting entry into the water and shall sound pool side and within the home.
Electrical: All electrical work shall comply with the national electrical code and must be inspected by an approved third-party electrical inspection agency.
Final Inspection: All swimming pools shall have a final inspection conducted by the Town of Milton prior to there use.
